Acceptance of Terms
These Terms of Service (the “Terms”) apply to your use of www.culirock.com (the “Site”) and to every purchase you make from it. The Site is operated by Ilias Ventures LLC, doing business as CuliRock (“CuliRock,” “we,” or “us”). “You” means anyone who visits the Site, creates an account, joins our list, submits content, or places an order.
Agreement. By browsing the Site, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, Refund Policy, and Warranty page, which are part of the agreement. If you do not agree, please do not use the Site.
Right to refuse service. We may refuse service, close an account, or decline an order from anyone, for a lawful reason such as suspected fraud, abuse of staff, violation of these Terms, or a legal restriction. We will not refuse service for a reason the law prohibits, such as discrimination against a protected class.
Your legal rights stay intact. Nothing in these Terms removes a right that federal or state consumer law gives you. Where a law gives you more protection than a clause below, the law applies.
Eligibility
Age. You must be at least 18 years old, or the age of majority where you live, to place an order or create an account. A person under 18 may browse the Site only with a parent or guardian involved. A parent or guardian may place an order for the household and accepts these Terms for the minor. Our Site is not directed to children under 13, and we do not knowingly collect their information (see our Privacy Policy).
Accurate information. You agree to give true, current, and complete information at checkout and in your account, including your name, shipping address, email, phone number, and payment details, and to keep it up to date. Orders placed with false information or someone else’s payment method without permission may be cancelled.
Location. We sell and ship only to addresses in the United States. If you place an order for delivery elsewhere, we may cancel it and refund you.
Products, Pricing and Availability
Currency. All prices on the Site are in U.S. dollars (USD). Free shipping applies to every order delivered to a United States address. The price shown in your cart at checkout is the price we charge, and it matches the product page for that item.
- Price changes. We may change prices, offers, and product details at any time without prior notice. A change never affects an order we have already accepted.
- Quantity limits. We may limit the number of units per person, household, or order, for example to prevent bulk buying for resale. Our grinder is made for household use, not for resellers.
- Descriptions and images. We describe the grinder, its 1200W motor, its three plates, and its included attachments as accurately as we can. Colors may look slightly different on your screen because of display settings. Photos and videos are for illustration, and small differences in packaging or finish do not make a product defective.
- Typographical errors. If a product is listed at a wrong price, or with wrong information, because of a typographical or technical error, we may cancel any order placed for it, even after confirmation. We will tell you and refund the full amount promptly.
- Availability. Stock levels shown on the Site can change quickly. We do not sell meat, food, or consumable products.
Order Acceptance and Cancellation
Acceptance. Your order is an offer to buy. We may accept or decline any order. An automatic order confirmation email only confirms that we received your order. It does not guarantee that the product is in stock or that we have accepted it. We accept your order when we send a shipment notice with tracking details.
Why we may cancel.
- The item is out of stock or no longer available.
- Your payment is declined, reversed, or cannot be verified.
- We suspect fraud, unauthorized card use, or abuse of an offer.
- The price or product information contains an error (Section 3).
- Your order cannot lawfully be shipped to your address.
What happens next. If we cancel an order, we email you and refund any amount already charged. If we cannot ship within the time we promised, we will tell you, give you a new date, and let you cancel for a prompt refund, as the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435) requires.
Cancelling yourself. To cancel before your order ships, contact us right away at support@culirock.com or +1 307-333-0175. We cannot cancel an order that has already shipped, but you may return it under Section 7.
Payment Terms
Accepted methods. We accept Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, UnionPay, Google Pay, Apple Pay, Shop Pay, and PayPal. Availability of a method may depend on your device and location.
Authorization. When you place an order, you authorize us and our payment processors to charge the total shown at checkout, including any applicable sales tax, to your chosen payment method. You confirm that you are allowed to use that method.
Currency. Payments are accepted in U.S. dollars only. Your bank may charge a currency-conversion or foreign-transaction fee, which we do not control.
Sales tax. Where the law requires us to collect sales tax, we calculate it by your delivery address and show it at checkout before you pay. Where tax is not required, none is charged. We collect and remit sales tax in line with each state’s rules, including the remote-seller rules that followed the Supreme Court’s 2018 decision in South Dakota v. Wayfair.
Security. Payments run through Shopify’s encrypted checkout. CuliRock does not see or store your full card number. If you believe a charge is wrong, please contact us first. You also keep your right to dispute the charge with your card issuer under the Fair Credit Billing Act.
Shipping and Delivery
This is a summary. The full details are in our Shipping Policy, which controls if there is any difference.
- We are based in the United States and ship only within the USA. Shipping is free on every order to a U.S. address.
- Orders placed before the 2:00 PM Eastern cut-off start processing that day. Processing takes 1 to 2 business days, and delivery takes 4 to 6 business days after shipment, so 5 to 8 business days in total.
- Your grinder ships directly from our reliable overseas partner supplier. You receive a tracking link by email once it ships.
- Risk of loss passes to you when the carrier delivers the package to your address. If a package is lost or arrives damaged, contact us and we will make it right.
- Carrier, weather, customs, or volume delays can happen. These are outside our control, but we will keep you informed.
Returns and Refunds
This is a summary. The full terms are in our Refund Policy, which controls if there is any difference.
30 days to start a return
You have 30 days from delivery to start a return. The grinder should be unused, in original condition, and in its original packaging with all accessories.
10 days to refund
After we receive and inspect the return, we notify you of approval or rejection. Approved refunds go to your original payment method within 10 days.
Who pays shipping
If you changed your mind, you pay return shipping. If the grinder arrived damaged, defective, or incorrect, we pay.
Contact us first
Email support@culirock.com for return instructions. Our Florida address is a mailing address, not a returns location. Please do not mail products there.
Warranty
Every CuliRock grinder comes with a two-year limited warranty against defects in materials and workmanship under normal household use. The full terms, including what is and is not covered, are on our Warranty page.
- Original purchaser only. The warranty applies only to the original purchaser. If you bought the grinder as a gift, the recipient may submit a claim using your order number with your permission.
- The warranty runs for two years from the date of purchase and does not cover normal wear, misuse, unauthorized modification, commercial use, or cosmetic wear.
- To make a claim, contact us with your order number and a description of the problem.
This is a limited warranty under the Magnuson-Moss Warranty Act. It gives you specific legal rights, and you may have other rights that vary by state.
Safe and Proper Use of the Grinder
The CuliRock Meat Grinder is an electrical appliance with moving parts and sharp cutting edges. You must use it as shown in the product materials, and you are responsible for using it safely.
Household use only
The grinder is made for home kitchens. Commercial, butcher-shop, or resale use is outside the warranty and these Terms.
Boneless meat only
Grind boneless meat that is cut to fit the feed opening. Do not grind bones, frozen blocks, or hard items.
Unplug first
Unplug the grinder before assembling, cleaning, or changing plates. Keep fingers out of the feed opening and use the food pusher.
Food safety is yours
Keep meat cold, clean every part, and cook ground meat to safe temperatures. See the USDA temperature chart. Game meat may require testing under your state’s rules.
If you are injured or the grinder is unsafe, stop using it and contact us. You may also report it at SaferProducts.gov.
User Conduct and Prohibited Uses
You agree not to do any of the following:
- Fraud. Place fraudulent orders, use a payment method without permission, abuse discount codes, or file a false claim, return, or chargeback.
- Unauthorized use of content. Copy, republish, or sell our text, photos, videos, or designs without written consent.
- Harmful or malicious activity. Hack, probe, or overload the Site; introduce viruses or malicious code; attempt to bypass security; or use bots, crawlers, or scrapers to collect data or place orders automatically.
- False content. Post fake, misleading, paid-for-without-disclosure, or defamatory reviews or other content, or pretend to be another person.
- Unlawful or abusive conduct. Break any law, harass our staff or other customers, or interfere with anyone else’s use of the Site.
We may suspend or block access, cancel orders, and report unlawful conduct to authorities when these rules are broken.
Intellectual Property Rights
Trademarks. “CuliRock,” our name, our logo, and related marks belong to Ilias Ventures LLC. You may not use them without our written permission. Other brand names on the Site, such as payment brands, belong to their owners.
Content. The Site’s text, product photography, videos, graphics, layout, and code are owned by CuliRock or used with permission and are protected by U.S. copyright and trademark laws.
Limited license. We give you a personal, non-exclusive, non-transferable right to view the Site and place orders for your own use. You may not reproduce, distribute, modify, or create works from our content without our prior written consent. To ask permission, write to support@culirock.com. If you believe content on the Site infringes your copyright, send us a notice at the same address with the details.
User-Generated Content and Reviews
If the Site lets you post reviews, photos, videos, or comments, the following applies.
- You own your content. By submitting it, you give CuliRock a non-exclusive, royalty-free, worldwide license to display, reproduce, and use it on the Site and in our marketing, shown with the name you entered. You promise you have the right to submit it and that it is truthful and based on your own experience.
- Honest reviews. We welcome honest reviews, including critical ones. We do not remove a review just because it is negative, and nothing in these Terms limits your right to share a truthful opinion, as the Consumer Review Fairness Act protects. If you received a free product or payment, you must say so.
- Right to remove. We may remove content that is unlawful, fake, threatening, hateful, spam, off-topic, or that shares private information or infringes someone’s rights, consistent with the FTC’s rule on fake reviews and testimonials (16 CFR Part 465).
Third-Party Services and Links
We rely on third parties, including Shopify, payment processors, shipping carriers, and our overseas fulfillment partner, and the Site may link to other websites. We do not control these third parties and are not responsible for their content, policies, or actions. Their own terms apply when you use them. Delays or errors by a carrier or payment processor are not our fault, but we will help you resolve them.
Limitation of Liability
Please read this section. To the fullest extent the law permits, CuliRock, Ilias Ventures LLC, and its owners, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of use, arising from the Site or the products.
- Misuse. We are not liable for harm caused by using the grinder in a way the product materials do not describe, by ignoring safety instructions, by using it commercially, by modifying it, or by unsafe food handling.
- Third parties. We are not liable for delays or failures by shipping carriers, payment processors, platforms, or other third parties.
- Cap. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
What this does not do. These limits do not apply to liability that cannot lawfully be limited, including injury or death caused by our negligence, fraud, or willful misconduct. Some states do not allow the exclusion or limitation of incidental or consequential damages, so these limits may not apply to you.
Indemnification
To the extent the law allows, you agree to defend, indemnify, and hold harmless Ilias Ventures LLC and CuliRock from claims, losses, and reasonable legal fees arising from your misuse of the product or the Site, your violation of these Terms or the law, content you submit, or your violation of another person’s rights. We will tell you about a claim promptly. This does not require you to cover harm caused by our own fault or a defect covered by our warranty.
Disclaimer of Warranties
The Site is provided “as is” and “as available.” We do not promise that it will be uninterrupted, error-free, or free of viruses, and we may suspend it for maintenance or security. We do not promise that third-party content or links are accurate.
Products. The grinder is sold with the written two-year limited warranty in Section 8. Under federal law, any implied warranty on the product, including merchantability and fitness for a particular purpose, is limited in duration to two years. Some states do not allow limits on how long an implied warranty lasts or do not allow disclaimers for consumer goods, so this may not apply to you.
Governing Law and Jurisdiction
These Terms and any dispute about the Site or your purchase are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. Subject to Section 18, the state and federal courts located in Palm Beach County, Florida have jurisdiction over disputes, and you and CuliRock consent to that jurisdiction and venue.
This does not take away the mandatory consumer protections of the state where you live. You may still bring a claim in your home-state small claims court or use any right that your state’s law says cannot be waived.
Dispute Resolution
Step 1: Talk to us. Most problems are solved with one message. Before starting any legal action, you agree to send us a written description of the problem, your order number, and what you would like us to do, at support@culirock.com. We will try to resolve it within 30 days.
Step 2: Binding arbitration. If we cannot resolve it, any dispute arising from these Terms, the Site, or your purchase will be settled by individual binding arbitration administered by the American Arbitration Association (adr.org) under its Consumer Arbitration Rules. We pay the fees the Rules assign to a business. The arbitration may be held by phone, online, or in your county of residence.
- Small claims. Either side may bring an individual case in small claims court instead.
- Injunctive relief. Either side may go to court to stop infringement or misuse of intellectual property.
- Warranty claims. Nothing here requires binding arbitration of a written-warranty claim where federal law does not allow it.
- Opt out. You may opt out of arbitration within 30 days of your first order by emailing support@culirock.com with the subject “Arbitration Opt-Out.”
Class action waiver. To the fullest extent the law permits, you and CuliRock each agree to bring claims only on an individual basis, and not as a plaintiff or class member in any class or representative action. If this waiver is found unenforceable for a claim, that claim will proceed in court, not arbitration. Nothing here waives your right to seek public injunctive relief where the law says that cannot be waived.
State-Specific Consumer Rights
Consumer protection is largely a state matter. Select a state or topic to see how its rules fit with these Terms.
Florida (where we are based)The Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. section 501.201 and following) protects consumers. You may complain to the Florida Department of Agriculture and Consumer Services or the Florida Attorney General. Our marketing texts follow the Florida Telephone Solicitation Act.
Our return terms are posted as Civil Code section 1723 requires. The Song-Beverly Consumer Warranty Act gives you implied-warranty rights that cannot be waived, and the Consumers Legal Remedies Act protects you from deceptive practices. Under Civil Code section 1789.3, California users may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210 (website: dca.ca.gov). You cannot waive your right to seek public injunctive relief.
General Business Law sections 349 and 350 prohibit deceptive acts and false advertising, and section 218-a requires a posted refund policy, which is in Section 7. Contact the New York Attorney General with concerns.
Some provisions of these Terms, such as limits on liability or on damages, may not apply to New Jersey residents to the extent the law forbids them, including under the Truth-in-Consumer Contract, Warranty and Notice Act. The Consumer Fraud Act still protects you. See njconsumeraffairs.gov.
The Texas Deceptive Trade Practices Act applies to your purchase, and nothing here waives your rights under it. Contact the Texas Attorney General.
Massachusetts Chapter 93A and the attorney general’s consumer regulations apply to Massachusetts residents. Washington, Illinois, Pennsylvania, and other states have their own unfair-practices laws. We apply the strongest protection that applies to your order. Find your state attorney general at naag.org/find-my-ag.
Every state has laws on sales tax, data-breach notice, implied warranties, and limits on liability and arbitration. If any clause of these Terms is not allowed where you live, that clause does not apply to you, and the rest of the Terms stay in force.
Electronic Communications and Privacy
You agree that we may send you required notices, order messages, and other communications electronically, by email or on the Site, and that these satisfy any legal requirement for written notice under the E-SIGN Act. Marketing emails and texts are sent only if you opt in, and you can opt out at any time. How we collect and use your information is explained in our Privacy Policy. Opt out of data sharing at our opt-out page.
Severability and General Terms
- Severability. If a court or arbitrator finds any part of these Terms invalid or unenforceable, that part is limited or removed as needed, and the rest of the Terms remain in force.
- No waiver. If we do not enforce a right right away, we have not given it up.
- Entire agreement. These Terms, with the policies they reference, are the whole agreement between you and CuliRock about the Site and your order.
- Assignment. You may not transfer your rights under these Terms. We may assign ours in a sale or reorganization of the business.
- Events beyond our control. Neither side is liable for delay caused by events beyond reasonable control, such as severe weather, carrier disruption, or government action.
- Accessibility. We aim to make the Site usable for people with disabilities. If you hit a barrier, email support@culirock.com and we will help you complete your order another way.
Changes to These Terms
We may change these Terms at any time. The effective date at the top shows the latest version. Changes apply from the date we post them, and they do not change the terms of an order you already placed. If a change is material, we will notify you by email or a notice on the Site. If you keep using the Site after a change, you accept the updated Terms. Please review this page from time to time. You can request earlier versions at support@culirock.com.
